Civil Litigation
| Do We Do Them? |
 |
Yes, and - frankly - We like winning! We've discovered that our clients do, too. Sometimes, that victory may come from making the other side admit the truth. Sometimes, the victory comes in denying the other party his or her claim. And, sometimes, the victory comes from nothing less than putting their skin on the wall. |
What Kind? |
| |
We have a whole site at Family Law if that's your area of interest; another for probate; and another for bankruptcy. We also handle general civil litigation, including wrongful death and deceptive trade practices act claims. |
What About Some Examples? |

House Mover. You see Tom's trucks up and down Preston Road. This day, he was moving a big house on a hilly county road just north of Stacy Road, just east of 75. The road made a "dog-leg" turn around an large, old pecan tree. The house got stuck in the tree. School was about to let out. Buses of kids would soon be trafficking the road - if they saw the problem in time. Tom and his workers mounted the roof with poles and chain saws. The branches they couldn't shove aside or lift they sawed off. Tom got the house safely moved and off the road. The landowners, however, were less than happy with the new "Venus de Milo" look of "the hugging tree" and called Wendle Turley. Jury verdict was substantially less than any justice court suit.
A Plano Chiropractic Clinic. About to be evicted as ploy to jack up lease renewal rent. Jacked landlord, instead, after commissioning study of area lease space and rent comps.
Tom, Again. Yes, Attorneys Frisco, P.C. has repeat clients! Moved house to point where two streams converge south of FM 720, 5 miles east of town. Bricks start to fall off. The porch sinks. Esteemed client doesn't do case any good by undeniably stating: "I'd better get right over before the whole thing just rolls into the creek." Judge can't believe Tom turns down $25,000 settlement offer. Asks client if he or his attorney is crazy, then brings in jury. Lose case. Win appeal [and, therefore, judgment for fees and costs]. Case returned to Collin County for retrial. Plaintiff folds when Mr. Burke starts selling off "view" to satisfy the judgment for fees and costs.
Corpus Dog Fight. Medical services (subcontract staff for emergency rooms) team splits. Injunctions; trustee; dozen or so hospitals; more professional associations; out of state corporations with similar names; off shore moneys; client's ocean-access home broken into by other side and client threatened while Mr. Burke slept through it all. Collaterally, involved with bankruptcy and dissolution of Houston clinic, and arbitration of claims by major lender bank. At end of deposition of client, Dr. drove Mr. Burke to airport, laughing all the way: "They got nothing, ...they don't get it!!" And they didn't.
Starwood. Fallout of two business associates. Big time homes under construction. Millions in dispute. Filed suit. Got opponent to agree to sell finished house to client for $100,000 over cost, then got court to appoint auditor to determine cost. Took video tape depos - first ever in Frisco.

"Wrongful Death". |
| |
A woman was killed while crossing Carroll Blvd. In Denton. The road was clear, weather clear, and view unobstructed. She had been standing on the median one moment and laying under a truck the next. Thorough demand letter backed up by news clippings, photos, and death certificate. Within 24 hours, Ins. Co. faxed confirmation would pay limits. It never knew what Attorneys Frisco's investigation developed: Long history of psychiatric disorder, repeated commitments to Wichita Falls Hospital. Attorney's duty is to client, not insurance company. |
