All kinds!! In the approximately 2 miles of Main Street between Preston Road and the railroad tracks, Attorneys Frisco, P.C. has sold or leased the "barbeque property" (several times), the corner service station, the next service station, a video store, a pharmacy, a pipeline easement, the old dairy Queen, got licenses and leases for 3 or 4 restaurants, the (former) YMCA (now Hunter & Associates), the coin-operated laundry, and (in 1977) its own office. And more. Ever hear of First State Bank or First National Bank (the original) of Frisco? Mr. Burke provided both with title work, conducted foreclosures, collected debt, and worked out loans for years at Frisco's original banks (and banks in Princeton, Milford, and Forney). [ Note: Forney's was once robbed by Bonnie & Clyde.] |
What Kind Do We Do? |

We've developed a restaurant in Durango, various professional medical associations in "the Valley", and non-profits like the Frisco Community Theatre, Frisco Bar Association, and Symphonia Frisco. We've negotiated Sbarro's entry into Dallas area food courts, obtained building permits for major area contractors, and brought "prenuptial contracts" to Frisco. We're terrific in real estate and idea generation. |
What Are Some Interesting Ones? |

One that we can now talk about took place in Dallas in the 1970's. A Kennedy memorabilia hound had purchased the Texas Book Depository and started operating it as a museum. At some point in time, the owner was facing (if memory serves) foreclosure. Owner hires Mr. Burke's client, an expensive "restorations" and remodeling contractor. "So as to not interfere with museum traffic" the contract was to be performed over a holiday weekend or when "no one - like a city inspector(?) - would be around". ( a not uncommon requirement in the trade) No one mentioned foreclosure when the job was described: Take a window from the back side of sixth floor of the Book Depository and substitute it for the window Lee Harvey Oswald used and then crate up "the window". Somewhat later, the new owner took inventory of the windows adorning the sixth floor, found one missing, took umbrage with the work of Mr. Burke's client, then called the police. For a fee, Mr. Burke was able to point out the following: (1) no theft - owner consent; (2) no other crime - no criminal mental state.
S.W. Corner of FM 423 and N. Colony. Contract to buy 6 acres of undeveloped land as site for new Eckerd’s. Deal falls through. Eckerd’s corporate wants 1 plus acre footprint, not to get in land development business. Re-cut deal for footprint and traffic easements for nearly price of the 6 acres. B&A then got developer to purchase & swap "Rain Cloud Ranch" in Ottawa, Kansas, for additional estimated $84,000 tax savings.

Typically, an agreement between buyer and seller where the seller will "finance the sale" by taking some part of the buyer's monthly payment and applying it to the service of seller's original loan - i.e.., an unauthorized assumption. |
What About A Breach Of Contract? |

We normally seek remedy under the DTPA a/k/a The Texas Deceptive Trade Practice - Consumer Protection Act. Why? Because the remedies are cumulative with all others and provide civil penalties against wrong-doers other statutes don't. |
