Who Do We Ask For? |

Edmund Burke. Mr. Burke will promptly schedule a consultation, advise you of your rights and remedies under the Probate Code, whether to write a will, power of attorney, medical power of attorney, physician's directive, or probate an estate. He will attempt to minimize the time and expense of probating the estate of a loved one. Word of Advice: Come to Attorneys Frisco, P.C. before you "need to". There is no second chance if the person becomes incapacitated before he or she begins "tax avoidance gifting", before designating a guardian for the baby, before signing a will, power of attorney, medical power of attorney, or physician's directive. |
What Kind Of Wills, etc? |

We write wills from the simplest to complex wills incorporating tax-avoidance trusts and powers of appointment. Our powers of attorney and physician's directives are legal, legible, and informative. Our standard wills minimize probate costs, designate guardians of minors, and contain a "no-contest" provision. |
What About Probate? |

"Probate" always first asks the question: "Was there a will?" If the Deceased died "intestate" or without a will, Attorneys Frisco, P.C. seeks to judicially determine heirship (this may be obvious to you, but not a title company) and distribute the estate at minimum cost. If the Deceased died "testate", B&A seeks to admit the will to probate at minimum cost. Not uncommon in smaller or less complicated estates, court proceedings can be greatly minimized. On larger estates, we routinely handle preparation of IRS Form 706 Estate Tax Returns, obtain Tax ID Numbers for the Estate, and provide the other collateral services necessary to an estate of this size. |
What About Guardianship? |

Attorneys Frisco, P.C. recently just wrapped up a Guardianship of an adult that lasted from 1980 to 2002. In January, 2002, the Guardian wrote to say [in part]: "What joy! You have been my lawyer for over twenty years and have treated me like a queen the entire time. How great is that!? Thank you for…the terrific work you do, the great friendship, and the excellent care you have always given. Friends Forever," [signature]. Yes, we passed the letter around the office a few times. There are two basic types of guardianship of minors: guardianship of the person and guardianship of the estate. There are additional nuances to guardianships for adults. "For An Adult Receiving Money From The Federal Government" is but one. We continue to be of assistance to those in need, whatever that need. |
What About Fees? |

Attorneys Frisco, P.C. fees for drafting instruments the client can read and understand are quite conservative. Fees for similar, coincidental services for a spouse are, generally, significantly discounted. Fees pertaining to probate and guardianship proceedings are competitive. Such fees are often subject to court approval. Billings are based upon services required and rendered, not the size of the estate. |
What About "Other Stuff"? |

Lost wills? Mr. Burke has caused many a lost will to be admitted to probate, most recently in Dallas County in 2001. Incapacitated Executor? This is getting more common as our population ages. Proper pleading will cause a competent substitute to be appointed - but only after we explore the necessity of appointment of an executor in the first place. All those words that end in TRIX"? That's simply Latin for "female". If the old will you have calls you an "executrix" and you're wearing a skirt, our pleadings will ask that you be appointed "executrix". Otherwise, we'll probably just call you "executor" or "administrator" not "administratrix". As Cole Porter aptly put it, at Attorneys Frisco, P.C., we've "Just Called The Whole Thing Off!" |
